Welcome to Kuza Career (referred to below as the “Platform,” “we,” “our,” or “us”). By accessing our website, purchasing our courses, utilizing our digital workspace assets, or interacting with our services, you (the “Student,” “User,” or “Customer”) agree to be legally bound by the following Terms and Conditions. Please read them carefully before creating an account or making a purchase.

 

1. Account Registration, Security, and Age Requirements

  • Eligibility and Age Restrictions: To create an account and use our Platform, you must be at least 16 years of age (or the legal age of majority in your jurisdiction) and fully capable of forming a binding legal contract. You agree to provide accurate, current, and complete details during registration.
  • Account Confidentiality: You are solely responsible for safeguarding your login credentials (username and password). You agree not to share your account, license keys, or dashboard access with any third party.
  • Security Breaches: Kuza Career is not liable for unauthorized access to your profile resulting from personal negligence. If you suspect your account profile data has been compromised, you must notify us immediately at our contact support email.

2. Account Inactivity and Automated Deletion Policy

  • Inactivity Period: To maintain platform performance, optimize server database space, and ensure user data privacy, Kuza Career enforces an account retention policy. If a student profile remains completely inactive for a continuous period of 12 months, the account will be flagged for automated maintenance. “Inactivity” is defined as a total absence of user logins, lesson progression, or communication with the platform.
  • Notification Process: Prior to executing any permanent database changes, Kuza Career will dispatch an automated warning notification to the student’s registered email address 30 days before the scheduled cleanup, giving you the opportunity to keep the account live by simply logging back into your dashboard.
  • Deletion Impact and Asset Forfeiture: If no login activity is recorded after the warning window closes, the account profile, along with all internal personal metrics and completion records, will be permanently scrubbed from our systems.
  • Important Exception for Paid Courses: To honor your lifetime learning access, accounts that contain active, fully paid premium course enrollments will not be subjected to absolute deletion due to structural inactivity. However, their system profile may be temporarily archived or put into a “dormant safe mode” to protect the data until the user securely logs in again.

3. Intellectual Property and Course Usage License

  • Proprietary Rights: All website assets, video lessons, downloadable PDF matrices, Boolean search cheat sheets, copywriting scripts, framework schemas, graphics, layout architectures, and text published on the Platform are the exclusive intellectual property of Kuza Career and its instructors.
  • Limited Individual License: When you purchase a course, you are granted a single-user, non-exclusive, non-transferable, revocable license to access and view the materials for your personal professional development.
  • Strict Restrictive Prohibitions: You are strictly prohibited from:
    • Copying, downloading (unless explicitly authorized via an official download link), scraping, republishing, or distributing course content on internal networks, public video drives, social media channels, or external LMS platforms.
    • Sharing login credentials with other individuals to split the cost of access.
    • Utilizing any of Kuza Career’s unique educational structures, formulas (such as the Action-Tool-Impact model), or technical walkthroughs to build, sell, or market a competing professional training or coaching program.
  • License Revocation: Any identified violation of this section will result in immediate termination of your access without notice or refund, and may subject you to statutory legal liabilities.

4. Detailed Payment, Billing, and Currency Terms

  • Payment Authorization: By purchasing a course or masterclass program, you authorize Kuza Career (and our integrated third-party payment processors) to charge the complete designated fee to your selected payment method (Credit/Debit Card, Mobile Money/M-Pesa, PayPal, etc.).
  • Localized Pricing and Currency Exchange: Prices listed on the platform may be dynamically displayed in local currencies (e.g., KES or USD). If you buy a course using a different currency than your baseline bank account, your financial institution may apply secondary currency conversion fees for which Kuza Career is not responsible.
  • Subscription and Installment Plans: If you enroll via a structured installment payment plan, you acknowledge that automated recurring charges will be deducted on your scheduled billing dates. Failure to clear a scheduled balance will result in the immediate suspension of your learning dashboard access until your account profile is settled.
  • Tax Responsibilities: Depending on your regional jurisdiction, statutory sales taxes, Digital Service Taxes (DST), or Value Added Tax (VAT) may be added to your checkout total during payment processing to comply with local financial laws.
  • Refund Policy: Because our digital products consist of instantly downloadable templates, proprietary copywriting assets, and immediate educational video access, all sales are final. By completing your checkout and accessing the digital course materials, you explicitly acknowledge that you forfeit your right to any statutory cooling-off periods, as access to our proprietary files is granted immediately upon payment validation. Exceptions to this rule are evaluated entirely at our discretion if verified technical errors prevent platform access.
  • Technical Errors and Pricing Discrepancies: In the event that a course is listed at an incorrect price due to a system bug, human typographical error, or backend malfunction, Kuza Career reserves the absolute right to cancel or refuse any orders placed at the incorrect rate, even if the transaction has already been processed.

5. Professional Earnings, AI Authenticity, and Platform Disclaimers

  • No Guarantee of Placement: Kuza Career provides educational training engineered to maximize optimization, searchability, and industry presentation on platforms like LinkedIn. We do not guarantee employment, interviews, salary increases, revenue growth, or specific contract securement as a direct outcome of completing our courses.
  • Project Accountability: Your success relies on variables outside of our control, including macroeconomic market shifts, your regional location, your existing baseline technical capability, individual job market dynamics, and the consistency with which you apply the strategies.
  • Third-Party Platforms & Algorithm Changes: Our profile instruction references external web tools (such as LinkedIn, Canva, and PowerPoint). Kuza Career is an independent academy. We are not officially endorsed by, affiliated with, or partnered with Microsoft, LinkedIn Corporation, or Canva. We have no control over their internal software algorithmic adjustments, updates, layout revamps, or account management policies.
  • Third-Party Terms of Service Compliance: Students assume all operational and legal risks when applying outbound strategies (such as Boolean network sourcing or direct messaging). Kuza Career is not responsible if a user misuses these techniques and triggers account restrictions or bans on external sites like LinkedIn by violating their respective professional community policies or user agreements.
  • Authenticity of Submissions and AI Limitations: While we provide copywriting formulas and frameworks, students are entirely responsible for the factual accuracy and authenticity of their profiles. Kuza Career assumes no liability if a student chooses to use Generative AI text tools to fill out their profile and subsequently faces platform down-ranking or disqualification by corporate recruiters for misrepresentation.

6. User Code of Conduct and Content Submissions

  • Platform Integrity: You agree not to upload malware, malicious code scripts, or attempt unauthorized database exploits, scraping, or cyberattacks against our digital infrastructure.
  • Respectful Space: When leaving feedback, participating in student message boards, or asking questions within module dashboards, you must communicate respectfully. Harassment, spamming, self-promotion, or offensive language will lead to a permanent platform ban without a refund.
  • Ethical Data Standards Notice & Proprietary NDAs: If a course assignment involves showcasing your professional portfolio, case studies, or interactive dashboards, you are completely responsible for ensuring that any text, screenshots, or metrics uploaded do not violate your past or current employers’ Non-Disclosure Agreements (NDAs), privacy rights, or intellectual property. You assume 100% legal liability for any corporate data leak caused by your profile modifications.
  • Testimonials and Student Reviews: By submitting feedback, reviews, direct messages, or success screenshots via our platform or community spaces, you grant Kuza Career a non-exclusive, royalty-free license to use these testimonials for promotional marketing purposes. We agree to obscure sensitive personal data (like full last names or company identifiers) upon request to maintain student privacy.

7. Limitation of Liability and Indemnification

  • As-Is Provision: All services, learning dashboards, and items on our website are provided on an “as-is” and “as-available” basis without warranties of any kind, either expressed or implied.
  • Service Availability and Maintenance Outages: Kuza Career does not guarantee uninterrupted, error-free operations of its learning portal. We reserve the right to temporarily shut down access for scheduled server maintenance, security upgrades, or due to external hosting infrastructure failures (Force Majeure) without liability or compensation to the user.
  • Liability Cap: To the maximum extent permitted by applicable law, Kuza Career, its directors, and its instructors shall not be held liable for any indirect, incidental, special, or consequential damages (such as loss of corporate employment, loss of profits, data leaks, or external account bans) arising from your use of our training content. Our aggregate liability shall never exceed the exact amount paid by you for the specific course in question.
  • Indemnity Obligations: You agree to indemnify, defend, and hold harmless Kuza Career against any claims, losses, legal liabilities, or costs arising out of your breach of these Terms, your misuse of platform features, or your violation of third-party user boundaries on external professional networks.

8. Modifications and Governing Law

Any legal arbitration or dispute resolution must be pursued exclusively within our local corporate jurisdiction.
